This Act includes key information sharing provisions between Transport for NSW and the National Heavy Vehicle Regulator to enable the smooth transition of heavy vehicle regulation functions and to ensure ongoing communication between the organisations. The Act addresses arrangements for the transfer of staff from Transport for NSW to the National Heavy Vehicle Regulator, and was therefore subject to the scrutiny and approval of Transport for NSW, the National Regulator and the relevant unions before being introduced into Parliament.

The Act is the final step of a 10-year national reform project in transferring responsibility for heavy vehicle regulation within NSW to the National Heavy Vehicle Regulator. The Act also includes critical employment safeguards for the staff being transferred under the Act, which required the approval of the relevant unions.

The Act passed Parliament on 6 May 2021.
